The courts aren't permitted to abuse this concept nor use it as an excuse to do whatever they want, they always have to explain their decisions and always make the decisions in accordance with the law. Judicial Independence is a fundamental pillar under which a citizen obtains justice.

Judicial Independence signifies that nobody and nothing, not a prosecutor, another judge, a politician, their political ideas, nor their personal preferences, should influence a judge in making a judicial resolution, subject only to the law. It DOES NOT imply that a judge can make an illegal resolution without consequences. In other words, Judicial Independence is designed to guarantee the legitimate rights of the citizens, not to allow a judge to produce resolutions at their whim with impunity.

This concept is made clear in a paper by Judge Baltasar Garzón Real entitled "PODER JUDICIAL E IMPUNIDAD".

"La primera pregunta que a mí se me ocurre es ¿es bueno que los jueces tengan poder?, o, por el contrario, deben ser meros medidores y aplicadores de normas; ¿deben tener un poder amplio en la sociedad democrática o no?. Lo cierto es que el poder de los jueces en un sistema democrático es un poder amplio, y necesariamente tiene que ser así, pero no es un poder que carezca de límites, es un poder acotado por la Constitución, acotado por las normas, y es un poder esencialmente responsable. Este último calificativo a veces se olvida con demasiada frecuencia, ese poder responsable, amplio, debe ir correspondido en la justa medida con una exigencia de responsabilidad frente al juez asimismo amplia: "a mayor poder mayor responsabilidad", y el mismo, debe ser ejercicio con mesura y prudencia pero sin cobardía. No es más progresista aquél juez que aplica más livianamente la norma que aquél otro que la aplica con el máximo rigor, cuando ese máximo rigor está dentro del recorrido legal de la norma y ha sido creado por el legislador para proteger al ciudadano."

The Spanish Constitution explains this concept VERY clearly:

Artículo 117 - 1. La justicia emana del pueblo y se administra en nombre del Rey por Jueces y Magistrados integrantes del poder judicial, independientes, inamovibles, responsables y sometidos únicamente al imperio de la ley.

Article 117 - 1. Justice emanates from the people and is administered on behalf of the King by judges and magistrates members of the Judicial Power who shall be independent, shall have fixity of tenure, shall be accountable for their acts and subject only to the rule of law.

There is no clause in the Constitution, nor other law, which permits a judge to break the law, quite the contrary, they are obliged to OBEY the law.
